Who handles a complaint about your advertising in New South Wales?

Not AHPRA. That surprises most people. AHPRA writes the advertising rules for every registered practitioner in Australia. It manages complaints in every state and territory except this one. In New South Wales the complaint goes to the Health Care Complaints Commission, and to the council for your profession. They agree between them who deals with it.

The national rules: AHPRA

  • Section 133 of the National Law covers advertising.
  • Bans testimonials, misleading claims and offers without terms.
  • The same rules apply in every state and territory.
  • The practice is responsible, whoever typed the words.

The Google reviews widget on the homepage. Under the National Law that is a testimonial in advertising. A Sydney practice waiting for a letter from AHPRA is watching the wrong postbox. The letter comes from the Commission, or from the council.
